The Variation Order is accordingly discharged and, in the exercise of my discretion, I decline to continue or replace it with a fresh injunction until the end of the April session of the Court of Appeal, so as to run with the Plaintiffs' own stay of my Order of December 21, 2018 discharging the Interim Injunction. That stay was granted on February 11, 2019 on tlie grounds that the Plaintiffs' appeal against that decision had realistic prospects of success and that if the stay was not granted the appeal would be rendered nugatory. I saw no inconsistency between my robustly finding that the Plaintiffs' substantive breach of fiduciary claim had no realistic prospects of success, on the one hand, and on the other hand accepting that the Plaintiffs' core appellate complaint that it was not properly open to me to reach that conclusion at the interlocutory stage, had realistic prospects of success before the Corirt of Appeal.

5. The Plaintiffs appealed the discharge of their Interim Injunction as of right2 and applied orally on December 21, 2018 for a stay pending appeal. I granted an interim stay until an application for a stay of the discharge of the Interim Injunction pending appeal corild be heard. The December 21, 2018 0rder, which was only recently perfected following contention as to its form, continued the Interim Injunction as modified by the December 7, 2018 0rder.
6. The Defendants in the event did not oppose the stay pending appeal application whicli
I granted on February 11, 2019. The effect of the stay which I granted was to keep the Interim Injunction in effect rmtil the end of the April 2019 session of the Court of Appeal. This was on the understanding that the Plaintiffs will seek to have their appeal listed for hearing in the next session of the Cayman Islands Court of Appeal (or where that is not possible, at a special sitting of the Court of Appeal if possible).

I am expecting (hoping) a closure of all the legal action and Hope resignation via OOCS in the next couple of months, the timing of which will be determined by the approval of the NY loan. And after that I expect to start receiving open and full communication from the bod as to how work is progressing on the ground as well as talks with BP and BH when they are able to do so. Yes relisting might be towards the end of the year but I certainly don’t expect to be in the dark until then. All to play for here until we hear otherwise so I remain positive. Imo. GLA

We can’t end up with a massive overhang of shares and the bod will want to avoid this at all costs so the NY funding is crucial to the OOCS imo

A post like that is just a wind up to already deeply stressed shareholders and seriously unappreciated. Just an acknowledgment that the company is aware of shareholder anxiety and the need for communication, even if it can’t be imminently forthcoming, and that they are still in communication as normal, and business as usual yada yada would be something. Pretty shoddy for a so-called PR company! All we can do is wait as we have zero influence on our fate which is totally FUBAR
