I am sure he does on the fiduciary claim RR, but at the end of the day Zaza signed a document which hands over the asset on the outcome of a default, and then defaulted. In that respect, it is 'black and white'. However, there are factors that led uyp to this...an orchestration by Hope to cripple the company and force this. Does that mitigate Zaza's decision to defalt? We think so! I think a Jury would too. But is down to the judge to decide. He may give FRR the benefit of the doubt and maintain the staus quo and grant injunction, or he may just consider the default on its own, and not the extenuating circumstances, and deny it. It is subjective and own to the judge.
