CAP-XX will win the Ioxus case because Ioxus aren't defending it. This outcome will be used against Maxwell/Tesla. Tesla have already been incorporated into the Court case against Maxwell. It's just a matter of time as to whether there's a settlement. Maxwell/Tesla have no chance of winning this court case however that doesn't mean they won't try to get away with a good financial settlement for themselves.

Considering Cap-xx is a business built on it's IP, AK naturally has to protect any infringements. The costs for this legal activity has been stated as low, so I'm all for AK taking on anybody no matter the size. I imagine each case has similarities and our legal team will be pre-empting objections.
I agree I saw just one part of it and this related to water getting into a Ustart device, so they decided to replace it with a conventional battery. Are you saying that this failure is effectively the death knell for Truckstart ?

I think we should read it like this: we still expect to win the ioxus case and the outcome will also be valid for Maxwell. Any other thoughts ? Why would they otherwise continue it ?

I once did an inventarisation about recall costs in normal cars. This is roughly $100 to get them back in the garage and keep the customer happy (coffee, some gadget, etc..) this is excluding workshop time and parts.
I do not know how this is in the professional market (could even be more since the buyer has lost proven income to claim)
I think this will be a serious claim and lost of confidence by automotive OEM. 1 Brandname is spoiled, OEM business gone, high number of claims are foreseen.
On the other hand: Suppose they lost the patent case. Then they for sure would go for a deal with cap-xx and not go for bankruptcy. They still could agree to have a good living from it both.

From what I can ascertain Trading the Daimler recall involved putting in a new battery in 584 vehicles with a labour time of 20 mins each. Hardly seems to warrant going belly up but perhaps it was just one of several recalls.?
What I don't get is that part of the summary says "Ioxus will continue to manufacture the same products through Systematic Power Manufacturing, LLC, a wholly-owned subsidiary of Systematic Power Solutions" . That being the case nothing changes so does that mean CPX has to start the process all over again i.e. against the new company? Is this now a legitimate way to get around such IP claims i.e. is it a loophole that is awaiting to be closed or a permanent solution? Perhaps People would tell us?
Thanks that makes sense. If the maxwell case goes well, at some point in the future when finances are stronger I would imagine xs power if continuing to infringe CPX IP will be a target.
I think Ioxus has sold its assets but kept its debts. So they simply go bust and there is no money to pay us. Maxwell was purchased as a going concern. Trading has speculated that the Daimler "claim" is the real reason for the sale . I hope he is right

Might be a stupid question but if ioxus got a way with it because they were sold to ioxus what is different about maxwell being sold to Tesla...I'm sure it's obvious but not seeing it at the moment.
OS, Ioxus had some recalls with OEM customers like Daimler. I think that is the reason why they sold their assests since the recall will for sure make them bankrupt en anyway not be able to find OEM customers (was a safety issue, firing of battery)
So their escape was to sell their assets and now they moved to the aftermarket where regulation is far more relaxed.
I think this is the story about Ioxus and I think Daimler is still looking for a start stop solution...who knows...
While I have not done any research we have been soundly out flanked by Ioxus . Now whether that was because we were about to win (or was it part of bigger move) I don't know . If it was the former it bodes well as I understand that the Maxwell case is similar. If something else is going on well who knows how it will turn out . Remember OJ

OS, good remark. What is anyway the latest update we got from the courtcase of Maxwell ? A bit confused since Ioxus is now part of aftermarket business.
After a successful launch I guess EM will now be a bit of a national hero. I wonder if any US court will now rule against his point of view. Oh well back on my head and back in my box
