Admiral, thanks. I already searched for this and couldn’t find it.
Apologies if already posted, for those who haven't paid for Pacermonitor, some free docs can be found, such as the original complaint and the below linked recent rejection of Maxwell's motion to dismiss:
https://www.ded.uscourts.gov/sites/ded/files/opinions/19-1733.pdf
This is all positive (though maybe Maxwell's filing was just a delay tactic they didn't expect to succeed, instead costing CPX to defend).
Polaris, same thoughts. Topped up today.

Ask the court.
TradingDutch
When is the court date?
can someone pls tell me the court date?
0.01 Ioxus is based on:
1 the recent increase of 0.01
2 500 mln outstanding shares vs 5 mln pay back determined by the Ioxus patent case.
So very rough estimate but I thought it is worth sharing...
Nice info Claretjay, so this is the calcutation:
Ioxus=0.01 (lawsuit)
XS power=0.01 (license)
Maxwell=0.1 (lawsuit)
Maxwell=0.1 ? (licence)
Current shareprice: 0.04
So... "shortly" we are on 0.26 ??
Regardless, he’s still allegedly and knowingly broken patent rules.
Having looked at both Tesla/Maxwell and Ioxus, you might expect a Court ruling figure 10 times the amount from Tesla compared to the 5m from Ioxus.
Happy days.
This means that Supercaps are not involved on "battery day".
But, I think this also means that a settlement with Cap-xx is more likely than acquiring them since supercaps are not strategic for Musk on the moment.
I like this since supercaps have far more wider applications than solely car batteries for Tesla and thus more grow potential for Cap-xx outside Tesla.
Hi all,
Not to spoil the party,
But Musk bought Maxwell for their battery technology and not Supercapacitors:
In 2012, Maxwell filed the patent 'Battery with the recyclable dry particle based electrode'

If anyone cares to actually look up each and every product on this list it would be much appreciated, ta.
I am not surprised. good post:-))
Hologram open spaces and techie tag team out to pour oil !!!! Imagine Musk on the 2nd September standing up and unveiling the new supercap battery to bring its range into line with the competition !!!
Next day some Journo write in the NYTimes how it’s the subject of a patent infringement case !!!!! Mmmmm custard pies all round !!! Think Open will need his commode
Virtually . Are you saying that the award in this case and the circumstances it was awarded in give CPX a caste iron unfailable guarantee that a similar case against Maxwell will succeed?. If so I transfer the tenner PC01 owes me to a bet with you. Incidentally I do see the negatives with with CPX mainly because we have had years of them (although not always their fault) . Not only that I have to put up with a crap board at BCFC who have been procrastinating now for 5 weeks only to offer the number 2 the job. Aaaaagh!!
Iouxus having transferred to XS power and XS knowing the situation re IP etc should provide some interesting discussion within bods and lawyers over nextweek or two, CPX have them in their sights and a court award to boot of $5mill, not one to ignore lightly and as we know Maxwell were offered the opportunity to licence through CPX but ignored the patent blatently and refused. A few years on those patent infringment have been proved in court and damages awarded, setting the precedent with a smaller fish (iouxus) and now in same court, same patents, same infringment we have Maxwell /Tesla ...often in these situations agreements are set away from court, however, if Tesla want a court case and damages awarded I'm sure CPX will be equally happy as there are years of royalty and compensation owed....CPX patent has been knowingly infinged and clearly the same court takes a dim view of such behaviour as shown by the sum awarded this week....a lot more to come it seems :-)
OPEN......God man why do you always see the negative.
This result is not only about the money from Ioxus but the precedent it sets for future cases and the position that puts CPX in......aaaagggghhhhh.
You are right there People>the unknown is how difficult Tesla could make life for us if we fail to accept any offer. I hope the recent increase continues but as I have said in the past with CPX there is "always something" which prevents success. In this case we have won a victory but have no spoils. The RNS simply prepares us for the fact we are going to getting not a lot out of Ioxus/XP. Surely somebody should have seen this coming
BigDavesDad - I think it's 75% of shareholders have to accept the offer.
BigDavesDad - Shareholders would get bought out either with money or maybe even Tesla Shares. Depends what Tesla offers to buy out CAP-XX and if it's accepted by shareholders. I can't remember offhand what percentage of shareholders would have to accept the offer for it to go through.
If tesla bought cpx out what would happen as a share holder?
Was against a significant number of products so I wonder if Tesla have informed the SEC or included comment on their recent results
