On what we have there it seems back to the interpretation of "ordinary course".
If there is a previously stated legal description for it then should be an easy outcome one way or other. If not then we are back to how judge (s) decide it should be interpreted.
Is "normal course" how business has carried out operations in normal day to day business previously.
OR
Is it how businesses in an industry behave in a particular set of circumstances?
Judge Conway deemed the later, I don't know if that is correct or not.
Award for "synergies' however above is ruled does seem very wrong however.
Some form of damages may well have been correct to award, but I do not understand synergies.

Was hoping to see more finer details to quash Fudge Barbara erroneous theory to award of lost synergies to CP without taking into account of the other factors involved from Cineworld in the first place to create synergies post merger ie using CINE infrastructure etc. will we get to see the detailed appeal apart from the statement of CP deviated from the ordinary course? Just want CINE to prove a point to the Wicked Fudge Barbara by wining the appeal.
@Wellington 99. I have emailed Cineworld IR to ask how we can get as I could not see how to get in on the Appeal Court website. Public can access records but would need some more specifics
@Bonkers, I don't think the appeal is a live feed. Seems to be a panel of 3-5 judges per the website and specifically says its not a full retrial and submission of evidence but specifically on the points of law where the judge may have erred. Hence, why would be informative to see the full submission like SIB vs TD
Ibthougjt the main part of the appeal was going to be the size of the judgement rather then question it all together.
Maybe they think the more they appeal tje more they can drop off, I don't know no.

I agree - very high stakes just to say the judge got it wrong, but I presume that is simply the most eye catching part. They will no doubt also argue that the methodology for calculating quantum was also erroneous.
If the press have got hold of it, then it must be publicly available - leaking legal docs that should remain sealed is presumably some kind of contempt of court otherwise!
I wonder if Investor Relations might enlighten us?
it will be interesting if the full filing becomes public soon to give further insight into the full basis of appeal, like the one Grant Thornton SIB liquidators posted for their appeal against TD which was around 34 pages double line spaced. My understanding reading the Ontario Appeal Court website is after the appeal is filed then there is a further 7 days to perfect the appeal docs ie flesh out the basis and supply supporting docs so we may get..i'd like to see a challenge in the appeal docs for synergies calc and not just ordinary course argument..GLA genuine LTHs

Least we also know some of the avenues cineworld are lodging their appeal against, I'm sure more details will come out over the coming days/weeks
