I echo the sentiments of others which is not to suggest corruption or leverage other cases where a questionable judgment was given. The email you have sent draws on familial ties which could introduce bias and a lack of impartiality. The ball is in the court of CINEs legal team and investor relations.

This I believe will have consitituted sufficient risk of potential bias in decision making and a clear conflict of interest in presiding over the Cineworld vs Cineplex case.

Mr David Mirvish has close ties with members of the Cineplex Board and is subsidiary as evidenced by the following

Further to this Mr David Mirvish was placed at Ms Phyllis Yaffe’s home in 2019 this article as a close gathering before a gala event that Mr David Mirvish co-hosted.

David Mirvish is clearly within a privileged position with access to the board chair and his brother in law (and by virtue his wife Judge Conway) are associated.
Conclusion: Mr Mirvish and Ms Yaffe share close bonds on a social level as well as in the efforts to support causes which they are both connected with
In addition the 2016 article below cites a dinner with “34 friends” hosted by a Mr Salah Bachir. Mr Bachir was until recently a former president of Cineplex Media, a subsidiary of Cineplex

We now conclude that Mr Mirvish (who’s brother in law is married to Justice Conway) has direct personal links with yet another high ranking senior personnel within the Cineplex family.
This article from January 2022 directly links Mr Salah Bachir with CEO Ellis Jacob in his comment about Mr Bachir’s departure from Cineplex after 16 years.

In addition this I attached a document that shows causes supported by both David Mirvish, Phyllis Yaffe, Salah Bachir and Cineplex all named. They are supporting the same clauses and and from the evidence I have presented have close links that go back many years to the present day being active in each other professional and social lives. This is beyond just moving in the same social circles.
What I take from this is that there is a clear familial link that traces Judge Conway to the upper senior management team within Cineplex.

I am writing to share information that I have gleaned regarding Justice Barbara Conway which I believe highlights a clear and unequivocal conflict of interest and potential bias relating the judgement of Cineworld vs Cineplex.
I am presenting to you this information in good faith that you may consider what implication this has on the recent judgement that was made by Justice Conway and scope to conclude that this judge should never have presided over this case.
The information contained herein has also been communicated to the Cineworld investor relations team as a way of highlighting these findings to Mr Mook Gredinger and the Board of Directors for Cineworld.
In the event you are already aware of the relationships I have highlighted in this communication I would be grateful for your response and acknowledgement that these connections were already known to you and your team and that they would have posed no barrier to Justice Conway being appointed as a judge in this case. Personally I find that very hard to believe but I am happy to be corrected on this.

Justice Barbara Conway is married to Mr Richard Conway, a lawyer. They are pictured together here at the Council for Canadian American Relations gala event in 2017
Justice Conway was also pictured at the same event with Audrey Mirvish who is the sister of Mr Richard Conway as evidenced by their fathers obituary filing below.

Audrey Mirvish is married to a Mr David Mirvish, a well established Toronto based theatre and entertainment business leader with lobbyist involvement
Mr Richard Conway is quoted in the article below as the brother in law of Mr David Mirvish and is clearly activity in the dealings Mr Mirvish has as he speaking about his work in this article i.e. they are not just aware of each other by family relations but are actively involved in each others lives.

“He only agreed to meet with me for this article because he wants to promote his Gehry project, and he had strict ¬conditions: he wouldn’t talk about his family or his personal life, just business. Conclusion – Mr Mirvish has a familial link with Justice Conway through her marriage to Mr Richard Conway who is clearly involved on a social and professional level.

I fully expect Cineworld to know, I don't particularly find it unusual for people of a certain standing in society to mix either.
In the small chance it's not known or declared of required then certainly no harm done with all work HNS has put into this.
Hussart no one is accussing anyone of dishonesty. It is the potential for bias based on a conflict of interest. If that conflict was declared and accepted then so be it. It is the risk of a conflict arising which is why a judge would excuse themselves.
Great work. But accusing a judge of dishonesty is a huge thing. I wonder if cineworld knows? Or if they do know, making that kind of accusation has massive consequences. It may even be held against them?
Great work @HNS, I wish the Cine board would be as proactive some here on this board. Hopefully this matter will be properly investigated but knowing our luck this will be swept under the carpet somehow.
