I would have been happy to shoulder some of the costs, I've never had or expected anything in life for free. Point is that unlike others, I wasn't invited to join the action group and to date I've not had a response to my letters to them. I'm not sure what others had that warranted them being able to join that I didn't. I'm glad that there are those like yourself who've received money back, but all shareholders should have had the the same opportunity.

The Court of Appeal made it clear in the case of CGL Group Ltd and others v RBS and others that where parliament has set a time limit for claims then any legal moves which attempt to circumvent that time limit should be blocked.
So although in theory a private criminal prosecution is still possible even if it was successful and a criminal penalty imposed, shareholders would not be able to claim any compensation.

In practice anyone silly enough to attempt a private criminal action would almost certainly face a potentially lengthy and costly battle to even get the case heard. The regulator has investigated the matter twice (once for their initial investigation and once for the independently supervised report ordered by the Treasury Select Committee) and concluded that there is insufficient evidence to bring criminal action. RBS could argue that it would be a malicious case. They could also argue that it would be a waste of court time to allow an action when there is little chance of success and so it would be against the public interest. A clever lawyer could probably find many other reasons to block the case

So anyone bringing such an action would face costly legal expenses and even if they won wouldn’t get anything back!

The idea that rbs is anything other than a company and that it is essentially a money shop is miss understood . Certainly in English law. I don't believe that they are above the law. If a judge thinks that is the case then we are all lost

RBS is only paying compensation to the groups who they settled with. Everybody else has missed the boat as legal acrtion is time limited to 7 years post rights issue. I appraoched and joined RBOS AG 6 years ago and have had to pay £1600 over the years to help fund group action. So have no sympathy for those who wish the rewards without shouldering the financial burden and risks in taking RBS to court. Incidentally as part of settlement RBS did not admit any liability or wrong doing so chances of them paying up to anybody not a member of the shareholders groups is zero.

Time government started issuing work permits - people from eu etc are going to come here anyway like it or not the world moves on - time to employ people to do the sweeping up and keep the system going
