In reading his posts John may have been spiked during last year and as a trader somewhat miffed with his stuck money since.

He has a point, most on here are a bit miffed at the activities to wreck the company in the midst of a successful three well oil campaign, and since prevented from restructuring the debt held over since 2006, delisting, and now part of a private company
Still by mid-March we should know if we are going to surf off into the wide blue yonder, or get wrecked on the beach.

That’s another highly plausible theory, AJW: that the court action was brought to get Cayman Grand Court supervision over arbitration to settle what’s owed to Outrider and replace it with the more favourable NY loan. Otherwise, Hope could simply veto the NY loan.

Exactly. Contra. This is pure speculation but I have wondered if the deliberate refusal by Zaza and Steve to hand over 250 million shares apiece on October 10, as Hope was demanding, was a way of exposing a massive short (made on the expectation that these shares would be handed over). The affidavit and e-mails would have been submitted at the time the injunction was requested (Kawaley applied it on 11 October). So, the injunction was put in place on the basis of what Kawaley later assessed as was a weak fiduciary duty claim but the injunction itself later exposed to Hope to the discovery of 'unlawful' activities.

I think you will find the YA share cockup and the settlement which followed, provided a new line of enquiry, which discovery has investigated.
What ever happened, we would have had to pay off the face value of the loan note, and any interest added to it over the last 12 years. The issue really is Hopeless's veto over replacing his loan with a less costly replacement, or loan on less onerous terms.
Any settlement needs to be legally supervised, otherwise Hopeless and OMF will wriggle out and continued their campaign to wreck the company and strip the assets before GG takes it off them as being unsuitable fly by nights.

I reckon the evidence was held back to reach an out of court settlement. If the evidence was put forward and they did reach an OOCS the judge can still proceed with the case. Therefore we have done hope a favor and the judge hasn’t seen the evidence so hope cannot get screwed, however we have the upper hand in negotiating the OOCS which will be a lot quicker. ZAZAS A GENIUS.
