If you are looking in Oopsi.....I'm wondering what happens if frr don't hand over their books on 29th May.
Do liquidators have extra powers if they do not receive ?
Two and a half weeks to wait, can't see hope getting his claws too badly into the other subsidiaries in that time.
Then it'll be another 2 months tortuous wait till jury trial if that comes about. I think we need that to get anywhere with this. We can but hope (Not that hope)
I think you are right, Taff. The judge is now waiting for Hope’s lawyers’ written objection to a preliminary injunction. Then there will be oral representations on June 6, then a judgement. Whether or not Maples can do any real damage in the meantime is unclear. 21 days for a liquidation on average - if there is anything to liquidate.
Hi Taffy.I think we both agree it is a draft order.
I really just wanted to remove any doubt that “ the judge had already heard oral arguments”.
As you say on previous occasions when we have had these draft motions/ orders it has been initially taken as good news in that it was thought it was the judge making a ruling.
There are enough ups and downs on this rollercoaster ride as it is lol.
Once again many thanks for publishing all the Pacer stuff as we can all make our own judgements.
Would appreciate Oopsi s thoughts on getting the injunction granted as he seems in a better position to judge.
I know he was not totally impressed with FRR argument on TRO but I understand that is much more of a rare event so perhaps a higher burden of urgency re proof” whereas the injunction is a much more common procedural event
Hi Ivyspivey....not sure I fully understand your question but the draft order is just that.....what FRR want the judge to rule on the 6th. (They have done this before and the judge ignored it) Their won’t be any oral argument until then so I don’t think the judge will make any ruling in advance of the 6th...that was my only point. I might be wrong....I usually am!
Taffy- is that not just the submission of a motion from FRR in advance of a decision so they say it as a fait accomplit but in reality it is just a statement of the outcome they want rather than any actual decision.
Ie the Judge May not have heard oral arguments.
Think it was mentioned on ii that somebody might attend.
1st though, is injunction being given to Frr that is needed.
I didn’t realise FoF were going to attend and report on court proceedings. Very nice
I don’t we will get a ruling until the court hearing on June 6th though. Among the the appendix and various exhibits attached to the last court submission was a draft court order for the judge to approve (FRR have done similar in the past). I have copied the beginning of it below. It mentions the judge ‘having heard oral argument’.
The Court, having considered the Motion for Preliminary Injunction (the “Motion”) of Plaintiffs Frontera Resources Corporation and Frontera International Corporation (collectively, “Plaintiffs”), the opposition thereto, and having heard the oral argument of counsel and having found good cause to do so, hereby orders as follows: 1. The Motion is GRANTED; 2. The Court finds that Plaintiffs are likely to succeed on the merits of their claims for Breach of Fiduciary Duty and Duty of Loyalty.
And lets not forget that Friends of Frontera have already indicated they will have someone in the court to witness proceedings so daily updates and more to the point, reporting the facts accurately.
Since claim was transferred over to Caliafornia have always believed that a jury trial would be in Frr's favour, but that seemed to be ebbing away. Now though things, just might be getting back on track & obviously on that we need the Injunction of which cannot think of any reason why this judge cannot rule in Frr's favour.
One thing on Hope, is that he has admitted that he generally only focused on Outriders interests when on the Frr BOD.
So this is why a jury trial was/is essential. Only in an open court in front of 12 good men and true can ALL the evidence be displayed, dissected, and all the links and plots discovered and examined. Hope in the witness box cross examined on all of this would be a sight to behold, and in front of a jury!. He would have to be a few sandwiches short of a picnic to look forward to that.
to you super detectives out there.
Surely, Zaza already knows where Dope was intending to stash / launder the stolen goods.
But, it wouldn't hurt to ensure that YJ is made aware of the Lothian connection, eh ?
If you're going to steal an expensive car, you've probs already got an order for it !
I have said previously that I'm sure Dope is very good at what he does
And this makes our plight all the more worrying
Zaza will deserve massive respect if we come out of this intact !!!
I still remain confident, and feel sure that all the tricks of Dope will be well known to the O&G community.
I believe that the parasite has got himself in so deep, that he can't even claw his way out
The only way for him is to keep fighting.
Maybe his Lawyers will pull the plug at some point ?
And flush the barsteward to where he belongs :-(
